Terms of Service

Badgerlytics, Inc.("Badgerlytics", "we", "our") provides a SaaS platform for analytics, A/B testing, feature flagging, and AI-assisted insight on your websites or applications. The Service includes the tracking script, SDK packages, the dashboard, AI features, and the underlying ingestion and reporting infrastructure.

You must be at least 18 years old to create an account. You are responsible for keeping your credentials secure and for all activity that happens under your account. Tell us promptly if you suspect unauthorized access.

• Free trial. Every account starts with a 7-day free trial of the plan you sign up for. No credit card is required to start the trial.
• Subscription. After the trial, you can subscribe to a paid plan. Fees are charged in advance for each billing period (typically monthly).
• Usage overages. If you exceed the events allowance included in your plan, overage fees apply at the per-event rate listed on the pricing page for your tier.
• Cancellation. You can cancel any time. Your service continues through the end of the current billing period. We do not provide refunds for partial periods.
• Taxes.Prices are exclusive of applicable taxes; you're responsible for any taxes owed in your jurisdiction.

You agree not to use Badgerlytics to:

• Collect personally identifiable information (PII) about visitors — names, emails, phone numbers, government IDs, etc. The platform is designed for anonymous analytics only.
• Process events on behalf of a website you don't own or aren't authorized to instrument.
• Reverse-engineer, resell, or sublicense the platform without written permission.
• Run security tests, load tests, or automated scrapers against our infrastructure without prior coordination with our team.
• Use the platform to violate any applicable laws or third-party rights.

You retain ownership of the analytics data your sites generate. We act as a data processor on your behalf and use the data only to provide the Service. See our Privacy Policy for specifics.

We work hard to keep the platform fast and available, but we don't offer a formal uptime SLA on standard plans. We do continue ingesting events even when the dashboard is briefly down for maintenance, so you don't lose data during routine upgrades.

You may terminate your account at any time. We may suspend or terminate accounts that violate these terms, materially abuse the Service, or fail to pay. We'll give reasonable notice for non-payment unless the situation requires immediate action.

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our aggregate liability arising from or related to the Service in any 12-month period is limited to the amount you paid us in that period.

Insights, AI recommendations, and reports are informational. You are responsible for the business decisions you make based on them.

We may update these terms occasionally. We'll update the effective date at the top of this page and, for material changes, notify account owners by email. Continued use of the Service after changes take effect constitutes acceptance.
